Terms of Service

These Terms of Service ("Terms") govern your use of JawaabAI's platform, website, and AI-powered WhatsApp sales agent service. By signing up, using our service, or interacting with a JawaabAI-powered WhatsApp bot, you agree to these Terms. Please read them carefully.
Short version: JawaabAI provides AI-powered WhatsApp automation to businesses. We are not responsible for the products or services sold through the bots we power. Businesses using JawaabAI are responsible for what their bot says and sells.
1. The Service
JawaabAI provides an AI-powered WhatsApp sales agent platform ("Service") that enables businesses ("Clients") to automate customer conversations, order taking, and lead capture on WhatsApp. JawaabAI is not a party to any transaction between a Client and their customers.
2. Eligibility
- You must be at least 18 years old to subscribe as a Client
- You must be a legally registered business or sole trader
- You must have a valid WhatsApp Business number that you are authorised to use
- You must comply with WhatsApp's Business Policy and Commerce Policy
3. Client Responsibilities
As a JawaabAI Client, you agree to:
- Provide accurate product/service information for your AI catalog
- Honour all orders and commitments made by your AI agent to your customers
- Not use JawaabAI to send spam, unsolicited messages, or messages that violate WhatsApp's policies
- Not use JawaabAI for any illegal, deceptive, or harmful purposes
- Keep your access credentials (access codes, API keys) confidential
- Notify us immediately of any unauthorised access to your account
4. Subscription and Payments
- Subscriptions are billed monthly. Plans start at PKR 4,999/month
- A one-time setup fee applies upon activation
- Payments are due at the start of each billing period
- Failure to pay within 7 days of the due date may result in service suspension
- Plans auto-upgrade when conversation limits are reached (you will be notified via WhatsApp)
- No refunds are offered for partial months or unused conversations
5. Free Trial
New Clients receive the first 50 conversations free with no credit card required. After the free trial, continued use requires subscribing to a paid plan. JawaabAI reserves the right to modify or end the free trial offer at any time.
6. Acceptable Use
You may not use JawaabAI to:
- Sell products or services prohibited by WhatsApp Commerce Policy (alcohol, weapons, adult content, etc.)
- Impersonate any person, business, or organisation
- Distribute malware, phishing links, or harmful content
- Harass, threaten, or harm any individual
- Violate any applicable Pakistani or international law
We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
7. AI Accuracy and Limitations
JawaabAI's AI agent is trained on information you provide (catalog, FAQs, persona). While we strive for accuracy:
- JawaabAI does not guarantee that the AI will always respond correctly
- You are responsible for reviewing your bot's behaviour and correcting errors
- JawaabAI is not liable for losses arising from incorrect AI responses
- The AI may occasionally misunderstand complex or ambiguous requests
8. WhatsApp and Meta Compliance
JawaabAI operates on WhatsApp's official Cloud API. Use of the Service is also governed by:
Violations of these policies may result in your WhatsApp number being restricted by Meta, which is outside JawaabAI's control.
9. Intellectual Property
- JawaabAI and its underlying technology remain our intellectual property
- The catalog, FAQs, and business information you provide remain your property
- You grant JawaabAI a limited licence to use your business information to operate the Service
- You may not copy, reverse-engineer, or resell the JawaabAI platform without written permission
10. Partner / Reseller Programme
Partners who refer clients earn a 10% recurring monthly commission. Partners must not misrepresent JawaabAI's capabilities or pricing. JawaabAI reserves the right to modify or terminate the partner programme with 30 days' notice.
11. Termination
- You may cancel your subscription at any time by contacting us on WhatsApp
- Cancellation takes effect at the end of the current billing period
- JawaabAI may terminate your account for repeated policy violations without refund
- Upon termination, your bot will be deactivated and your data will be deleted within 30 days
12. Limitation of Liability
To the maximum extent permitted by law, JawaabAI shall not be liable for:
- Any indirect, incidental, or consequential damages
- Lost revenue or profits arising from service downtime or AI errors
- Actions taken by Meta/WhatsApp that restrict your number (account restrictions, bans)
- Orders or commitments made by the AI that you are unable to fulfil
Our total liability in any case is limited to the amount you paid us in the previous 30 days.
13. Changes to These Terms
We may update these Terms at any time. We will notify active Clients via WhatsApp at least 7 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the Islamic Republic of Pakistan. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to arbitration in Lahore, Pakistan.
